Abstract

Constitution-building and transitional justice processes share many common goals, but there are also risks, by assuming that the two processes are so similar that they are considered complementary, or that one process can do the work of the other at the same time. For example, interim constitutional documents should include laws to address the humanitarian ramifications, effects and outcomes of conflicts, overcome obstacles and obstacles to the return of displaced persons and refugees, mechanisms to ensure the return of property unlawfully seized during conflicts, as well as amnesty cases, procedures and other content within the field of transitional justice.
